inbox.ky — Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you (“you”, “your”) and INBOX.KY Ltd. (a Cayman Islands company), trading as inbox.ky (“inbox.ky”, “we”, “us”, “our”), governing your use of the inbox.ky website and email services (the “Service”). By using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old (or the age of majority where you live) and able to form a binding contract. If you use the Service for an organisation, you confirm you are authorised to bind it.

2. The Service

inbox.ky provides Cayman-based email services, which may include:

Identity — a permanent name@inbox.ky address that forwards to an inbox you already use (forward-only; no mailbox, no “send-as”);
Mailbox — a hosted inbox you send and receive from;
Cayman Pro — business communications (custom domain, admin, and optional voice/messaging features), provided on tailored terms and pricing.

Features, tiers, and pricing may change as the Service develops.

3. Reservations

When you choose a name@inbox.ky, we may reserve it for you while we set up your account. A reservation is free, soft, and non-binding: it is not a contract to provide service, creates no mailbox, takes no payment, and holds the name on a best-efforts basis only. We may decline, change, or release a reservation (for example, names that are reserved, infringing, abusive, or impersonating). We will confirm when your account is ready to use.

4. Accounts

You are responsible for your account, your login credentials, and all activity under your account. Keep your credentials secure and tell us promptly at abuse@inbox.ky of any unauthorised use. You are responsible for keeping access to your forwarding destination address.

5. Acceptable use

Your use of the Service is subject to our Acceptable Use Policy (including fair-usage and anti-spam rules), which forms part of these Terms. Breaching it may lead to suspension or termination.

6. Fees, billing & renewals (paid plans)

Prices are shown in Cayman Islands dollars (CI$) unless stated otherwise and may exclude applicable taxes/fees.
Paid plans are billed in advance on a recurring basis and renew automatically until cancelled. You can cancel future renewals at any time; cancellation takes effect at the end of the current billing period.
Cayman Pro is priced individually; its commercial terms are set out in your order or quote.
Except where required by law, fees are non-refundable. We may change prices on reasonable notice, effective at your next renewal.

7. Your content and email

You retain all rights to your email and content. You grant us only the limited rights needed to operate the Service for you — to receive, transmit, route, forward, store, back up, and secure your email. We handle content per our Privacy Policy. You are responsible for your content and for having the rights to send and store it.

8. Availability, changes & “as is”

We work to keep the Service reliable but, except as expressly stated in a separate written SLA, the Service is provided “as is” and “as available” without warranties of any kind, to the fullest extent permitted by law. We may modify, suspend, or discontinue parts of the Service; if we discontinue a paid feature you rely on, we will give reasonable notice and a pro-rata refund of prepaid, unused fees for that feature where required.

9. Suspension & termination

We may suspend or terminate your access if you breach these Terms or the AUP, fail to pay, or to protect the Service, other users, or comply with law. You may stop using the Service and close your account at any time. On termination, your right to use the Service ends; we will handle your data per the Privacy Policy and, where practical, allow a reasonable window to retrieve your data before deletion.

10. No affiliation with the telco

inbox.ky is an independent, Cayman-owned service. We are not affiliated with, endorsed by, or connected to Cable & Wireless, Flow, or the operators of candw.ky. References to candw.ky are for identification and comparison only; all third-party names and marks belong to their respective owners.

11. Intellectual property

The inbox.ky name, brand, site, and software are owned by us or our licensors. We grant you a limited, revocable, non-transferable right to use the Service per these Terms. You may not copy, resell, or reverse-engineer the Service except as the law allows.

12. Third-party services

The Service relies on third-party providers (e.g. hosting, email delivery). We are not responsible for third-party services outside our control, though we choose providers carefully.

13. Disclaimers & limitation of liability

To the fullest extent permitted by law:

we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill;
our total aggregate liability arising out of or relating to the Service is limited to the amounts you paid us for the Service in the 12 months before the event giving rise to the claim (or CI$100 if you have paid nothing);
nothing in these Terms excludes liability that cannot be excluded by law. Email delivery depends on networks and systems outside our control; we do not guarantee that every message will be delivered, received, or stored without delay or loss.

14. Indemnity

You agree to indemnify and hold us harmless from claims, losses, and costs arising from your misuse of the Service, your content, or your breach of these Terms or the AUP, to the extent permitted by law.

15. Governing law & disputes

These Terms are governed by the laws of the Cayman Islands, and you and we submit to the exclusive jurisdiction of the courts of the Cayman Islands, without regard to conflict-of-laws rules.

16. Changes to these Terms

We may update these Terms. We will post the updated version and update the date; material changes take effect on reasonable notice. Continuing to use the Service after changes means you accept them.

17. General

If any provision is unenforceable, the rest remains in effect. Our not enforcing a right is not a waiver. You may not assign these Terms without our consent; we may assign them to an affiliate or successor.
